DESCRIPTION:The Coalition is pleased to host a webinar on April 24 from 12:00 – 1:00 PM (ET) with guest presenters Jacelyn Ferriell\, Senior Manager\, Government Contracting\, Aprio and David S. Black\, Co-Chair\, National Government Contracts Team\, Holland & Knight LLP on Joint Ventures on the GSA Schedule: Understanding Unique Challenges and Risks.  \nJoint ventures are a hot structure for seeking a GSA Schedule\, but they are awkward and there is still a learning curve.  With the two-year bidding period for small business JVs limited to contracts but not task orders\, many M-P JVs and even all-small JVs are seeking GSA Schedule contracts because of the long ordering period that is not subject to the two-year bidding limitation.  While this presents a great opportunity\, there are several compliance risks for a JV that holds a GSA schedule.  When not fully understood these risks can potentially impact both the JV’s GSA schedule and GSA schedules held by individual JV members.  \nDuring the webinar\, they will address key hurdles and risks when a joint venture seeks and then holds a GSA Schedule. DESCRIPTION:The Department of Justice (DOJ) and qui tam whistleblowers continue to actively pursue enforcement actions against government contractors under the civil False Claims Act (FCA)\, presenting heightened risks to contractors subject to an increasingly complex array of compliance obligations in fast-changing areas such as cybersecurity.  In this program\, Perkins Coie Partners Alexander Canizares and Barak Cohen will provide an overview of the FCA enforcement landscape in 2024 with a focus on developments relevant to commercial contractors. \nDrawing on their experience handling FCA investigations and litigation as well as mandatory disclosures\, Alex and Barak will address DOJ’s procurement fraud enforcement priorities\, including its Civil Cyber-Fraud Initiative focusing on using the FCA to redress non-compliance involving cybersecurity and the implications of FCA enforcement for contractors facing new and emerging programs such as DoD’s cybersecurity assessment initiative.  The presentation will also address DOJ efforts to incentivize companies to self-disclose non-compliance as well as cooperate in DOJ investigations. SUMMARY:The BIOSECURE Act’s Potential Impact on the Biotechnology Supply Chain\, July 10
DESCRIPTION:Taking a page out of playbook used to establish the framework that excludes products of certain Chinese telecommunications companies from the federal market (e.g.\, the “Huawei ban”)\, the BIOSECURE Act would prohibit the federal government from purchasing biotechnology equipment or services from certain “companies of concern.”  The Act does not stop there.  It would also prohibit Executive agencies from contracting with a company that would use biotechnology equipment or services from a “biotechnology company of concern” in the performance of a federal contract. \nPlease join the Coalition for a webinar on July 10 from 11:30am – 12:30pm EST as we host four attorneys from Hogan Lovells’ Global Regulatory practice. DESCRIPTION:In recent years federal contractors have been challenged to adapt their legal and compliance strategy to a growing regulatory focus on securing the federal supply chain.  In particular\, technology bans and restrictions have been used to mitigate data security and surveillance concerns associated with foreign information and communications technology (ICT) – imposing significant new due diligence measures over extended third-party ecosystems.  These kind of strict\, targeted prohibitions are expected to play a role in how the federal government manages supply chain risk moving forward. \nFurthermore\, recent bellwether federal procurements (GSA OASIS+\, GSA Alliant 3\, NASA SEWP VI\, ASTRO\, Polaris\, 8(a) STARS III\, and DISA DES\, to name just a few) have required offerors to disclose measures taken to assess and limit supply chain risk as part of contract award – providing a glimpse into the importance of Supply Chain Risk Management (SCRM) as a contract award discriminator. \nFederal agencies and the government contractors that serve them will increasingly be obligated to know exactly where products\, components\, software and services are being sourced\, throughout all levels of an increasingly complex and global supply chain.
