A Busy April and What’s Ahead in May
April has been an active and productive month for the Coalition for Common Sense in Government Procurement (Coalition), with a series of committee meetings and webinars that brought together government and industry experts to discuss key procurement developments. April Events Recap
On April 8, the Cyber & Supply Chain Security Committee hosted a Cybersecurity Policies & Programs Update featuring Townsend Bourne of Sheppard Mullin and Michael Gruden of Crowell & Moring. The discussion focused on recent federal cybersecurity policy developments and what they mean for contractors.
On April 14, the Information Technology/Services Committee welcomed Adam Soderholm, Director of the General Services Administration (GSA) Center for Professional Services. The session provided an overview of Professional Services and Human Capital (PSHC) priorities, along with Professional Services Category spend trends including GSA vehicle market share, an update on OASIS+, and a strategic snapshot of PSHC.
On April 16, the Coalition hosted Sheppard Mullin attorneys Jonathan Aronie, Anne Perry, and Ryan Roberts for a timely discussion on Executive Order 14398, Addressing Diversity Equity and Inclusion Discrimination by Federal Contractors, and its forthcoming contract clause. The panel walked through the implications of the new requirements and offered a framework for compliance, highlighting considerations for legal, human resources, contracts, and subcontract management functions.
On April 22, the Coalition held a webinar on Transactional Data Reporting (TDR) featuring The Gormley Group’s Andrew Sisti and Lauren Keshavarz. With TDR expanded across the Multiple Award Schedule (MAS) program through Refresh 31, the session covered key requirements, reporting elements, and practical compliance considerations, including the transition from Commercial Sales Practices to TDR and best practices for reporting.
On April 23, the Coalition hosted a legal update webinar featuring PilieroMazza Partner Nichole Atallah. The discussion covered a range of recent legal and regulatory developments impacting government contractors, including SBA rule changes, joint venture considerations, Government Accountability Office (GAO) protest activity, Cybersecurity Maturity Model Certification (CMMC) 2.0 implementation, and compliance requirements related to emerging national security and artificial intelligence policies.

Laura Stanton to Serve as Acting FAS Commissioner
The General Services Administration (GSA) has named Federal Acquisition Service (FAS) Deputy Commissioner Laura Stanton as Acting Commissioner, following the departure of Josh Gruenbaum.
Stanton will serve in the role until a permanent commissioner is appointed. In a Federal News Network article, GSA Administrator Edward Forst was quoted as saying, “With Laura at the helm, I am confident that FAS will continue to build upon the significant accomplishments achieved over the last 15 months.”
Stanton was named Deputy Commissioner of FAS in April and has been with GSA in multiple leadership positions for more than 25 years.
Army MAPS Proposal Deadline Extended to May 8
The Department of the Army has extended the deadline for the MAPS solicitation to May 8.
The Coalition will continue to monitor developments related to the MAPS procurement. Next week’s blog will further examine considerations related to contract duplication and its potential implications on the federal acquisition landscape.
In addition, the Coalition will issue a survey on contract duplication for members next week.
Agencies to Prioritize the Purchase of Commercial Products and Services
The Office of Management and Budget (OMB) recently issued memorandum that urges agencies to maximize the acquisition of commercial products and commercial services per Executive Order 14271, Ensuring Commercial, Cost-Effective Solutions in Federal Contracts. Specifically, the memo directs agencies to report information on recent and near-term awards for non-commercial procurements.
The memo requires agencies to submit the value and procurement instrument identifier (PIID) for each non-commercial award made between April 15 and September 30, 2025. For contracts exceeding $10 million, agencies must provide additional details, including contract pricing type and total value. OMB also directs agencies to explain any procurements that are not expected to transition to a commercial solution at the next option period, supported by market research and price analysis.
Looking ahead, agencies are required to outline the internal mechanisms and guidance in place to ensure that the agency’s Senior Procurement Executive (SPE) reviews all planned non-commercial procurements.
The memo also addresses agency “competition advocates.” Agencies must designate a policy official to serve in this role to promote increased use of commercial products and services. These officials are expected to meet regularly to share best practices.
VA Extends FSS Contract Terms to 20 Years
Last week, the Department of Veterans Affairs (VA) issued a mass modification across multiple Federal Supply Schedules (FSS) to extend contract terms from 10 years to up to 20 years.
This change aligns VA FSS contracts with the GSA Multiple Award Schedule (MAS) program, which operate under an “Evergreen” structure. Under the updated framework, contracts will include a five-year base period and three five-year option periods, for a total potential term of 20 years. Signed bilateral modifications are due by May 1, 2026.
For pharmaceutical and biologics contracts (65IB), the VA previously indicated that a full renewal process will be required to obtain Evergreen status, and that short-term extensions to existing contracts may be necessary in the interim.
VA also noted that extending contract terms may trigger additional regulatory requirements. For example, contracts that previously did not meet certain thresholds may now be subject to clauses such as small business subcontracting plan requirements.
Anticipated changes to FSS contracts based on recent executive orders are not reflected in the current mass modification. The mass modification can be accessed through the following links:

GSA and OPM to Share Federal Office Space
GSA announced a headquarters modernization initiative at 1800 F Street NW, along with a partnership with the Office of Personnel Management (OPM) to reduce underutilized federal office space and strengthen the government’s real estate footprint.
Beginning in July, GSA will temporarily relocate its headquarters operations to the Theodore Roosevelt Federal Building, where it will co-locate with OPM. This move represents the first phase of a broader effort that will result in a shared GSA-OPM headquarters at 1800 F Street. The renovated facility is expected to open in December 2028, after which GSA plans to begin accelerated disposition of the Theodore Roosevelt Federal Building.
According to GSA, approximately 40 percent of its current headquarters space is uninhabitable due to deferred maintenance, underscoring the need for modernization. The agency also noted that the initiative is intended to address longstanding challenges related to building utilization and maintenance.
“GSA and OPM are taking unprecedented action by coming together to fortify America’s real estate portfolio and tackle the delinquent maintenance and vacancies that have plagued it for decades,” said GSA Administrator Edward C. Forst. “The GSA team has built a roadmap for federal agencies to operate under one roof and deliver what the American people expect—results that respect their tax dollars.”
SBA Considers Changes to Small Business Procurement Scorecard
Federal News Network reports that the Small Business Administration (SBA) is considering updates to its small business procurement scorecard methodology, which is used to evaluate agency performance reaching their small business contracting goals.
Among the proposed changes is a shift in focus toward contracting with veteran-owned businesses, including both service-disabled and non-service-disabled firms. SBA is also considering reducing the use of sole-source 8(a) contracts and renaming the “small disadvantaged business” category to “economically disadvantaged,” which would expand the category to include both traditional SDB firms and certain veteran-owned businesses. Additional factors under consideration include increased emphasis on preventing fraud and assessing how agencies deliver “competitive value to the taxpayer.”
SBA is also proposing changes to how agency performance is weighted. Under the draft fiscal year 2026 scorecard framework, prime contract awards would account for 50 percent of the score, subcontracting 25 percent, serving veterans 15 percent, providing competitive value 10 percent, and partnering with SBA to reduce fraud 10 percent. Notably, these factors total 110 percent, and SBA has not provided details on how the revised scoring methodology would be calculated.
This represents a shift from the current methodology, which includes four primary categories:
- Prime contracting achievement: 50 percent
- Subcontracting achievement: 20 percent
- Year-over-year changes in the number of small business prime contractors: 10 percent
- Office of Small and Disadvantaged Business Utilization (OSDBU) peer reviews: 20 percent
The proposed changes have raised concerns among lawmakers and industry stakeholders. Questions have been raised about the timing of the updates mid-fiscal year, the lack of clarity around implementation, and the potential impact on small business participation and contracting opportunities.
FAS Catalog Platform Now Supports BPA Catalogs
GSA announced that Purchase Channel Blanket Purchase Agreement (BPA) catalogs can now be supported on the FAS Catalog Platform (FCP).
Following a pilot in December 2025 with select catalogs from AdvantageSelect, 2GIT Products, and MRFS, GSA is expanding FCP access to additional eligible Purchase Channel BPAs.
How will I know when my BPA catalog is eligible?
MAS parent contracts will become eligible for FCP first, with associated BPAs becoming eligible after the MAS contract is successfully onboarded.
Authorized Negotiators will receive automated notifications 28, 14, and 7 days prior to eligibility, including next steps and onboarding instructions. Only users listed as Authorized Negotiators will receive these notifications. GSA recommends ensuring appropriate users are listed on both the MAS contract and associated BPA(s).
How are BPAs managed in FCP?
MAS parent catalogs and BPA catalogs will be managed separately within FCP, each requiring its own updates and maintenance. BPA catalog history will also reflect MAS catalog history, providing visibility into contract-level changes and supporting management of BPA-specific offerings.
When will other BPA types onboard to FCP?
GSA is prioritizing MAS BPAs with product catalogs that publish to GSA Advantage, including those listed as Authorized BPA Vendors on the Vendor Support Center.
A broader rollout is expected over the next one to two years and is anticipated to include:
- GSA-awarded Purchase Channel BPAs (e.g., 2GIT Products, AdvantageSelect, MRFS2)
- Services BPAs (e.g., SCRIPTS)
- Requisition Channel BPAs (e.g., JANSAN, IT, MRO)
- 4PL
GSA Releases TDR Resources
GSA recently shared resources to help contractors prepare for mandatory Transactional Data Reporting (TDR) under the Multiple Award Schedules (MAS) program. TDR participation will become mandatory once MAS Refresh 31 goes into effect, which is expected in July.

VA Announces Record Claims Processing
The VA announced that it processed a record number of Veteran disability claims in fiscal year (FY) 2025. The VA completed more than 3 million claims in FY25 and is on a similar pace in FY26, processing more than 1 million claims by February 2, 2026.
Processing times have also improved. The average time to complete a disability claim decreased from 141.5 days to 80.7 days, while accuracy increased to 94.02 percent.
The VA also processes claims for Veterans Pension, Survivors Pension, and Dependency and Indemnity Compensation (DIC). The number of veterans waiting for benefits fell below 100,000 for the first time since 2020. Processing times for these claims have declined significantly:
- Veterans Pension claims: from 170 days to 57 days
- Survivors Pension claims: from 172 days to 73 days
- DIC claims: from 163 days to 73 days
- Burial claims: from 70 days to 31 days
Federal AI Use Cases More Than Double in 2025
According to Nextgov, federal agencies reported 3,611 artificial intelligence (AI) use cases in 2025, a 105 percent increase from 2024, based on the latest inventory from the Office of Management and Budget (OMB) across 56 agencies. Reporting is required under federal law, although national security and Intelligence Community use cases are largely exempt.
The Department of Health and Human Services reported the highest number of use cases (447), followed by NASA (425), the VA (367), the Department of Energy (340), and the Department of Justice (314).
Common applications include text processing and summarization, data analytics, predictive modeling, and chatbot services. Of the 445 use cases designated as “high-impact,” the VA accounted for nearly half, including applications such as clinical data summarization and call center automation.
Agencies also reported on the tools supporting these use cases. Microsoft Copilot products were the most widely used, while Anthropic’s Claude has been used in a smaller number of cases and is being phased out following federal policy changes.

The NASA SEWP program has released a new resource highlighting key differences between SEWP V and SEWP VI.
The resource includes a video and accompanying slides that provide an overview of what contractors can expect under SEWP VI, including changes from the current vehicle.

Legal Corner – Leveling Up: What To Know About the New FedRAMP Incident Response Procedures

On April 8, 2026, the Federal Risk and Authorization Management Program (“FedRAMP”) released Request for Comment (“RFC”) – 0031, Updated Incident Communications Procedures. The document aims to clarify and standardize incident reporting expectations to be more consistent and practical. Comments may be submitted through May 12, 2026. This RFC is part of FedRAMP’s broader modernization effort as it transitions to FedRAMP 20x, as discussed in our prior blog post.
New Definition for Incident & Estimated Impact Ratings
The new proposed incident response procedures focus incident reporting on ‘likely’ or ‘confirmed’ incidents that threaten the confidentiality or integrity of federal customer data. In new FedRAMP terms, an incident will be defined as “an occurrence that—(A) actually or imminently jeopardizes, without lawful authority, the integrity, confidentiality, or availability of information or an information system; or (B) constitutes a violation or imminent threat of violation of law, security policies, security procedures, or acceptable use policies.” 44 U.S.C. § 3552(b)(2).
Cloud Service Providers (“CSPs”) will assign an estimated potential adverse impact rating to each incident, based on expected impact to government customers as follows:
- N1 – Negligible Adverse Effect: Incident is expected to have a small negative impact on one or more agency users of the cloud service offering.
- N2 – Limited Adverse Effect: Incident is expected to have a minor negative impact on one or more agency users of the cloud service offering.
- N3 – Serious Adverse Effect: Incident is expected to have a significant negative impact on one agency user of the cloud service offering.
- N4 – Catastrophic Adverse Effect or Serious Adverse Effect: Incident is expected to have either a severe negative impact on one agency user of the cloud service offering or a significant negative impact on multiple agency users of the cloud service offering.
- N5 – Catastrophic Adverse Effect: Incident is expected to have a severe negative impact on multiple agency users of the cloud service offering.
Initial Incident Notification
Once a federal reportable incident has been identified, FedRAMP proposes default notification requirements for all affected parties unless otherwise agreed to in writing:
- Notify FedRAMP at fedramp_security@gsa.gov or fedramp_security@fedramp.gov.
- Follow each agency customer’s instructions and contact arrangements through the agency’s security point of contact.
- Upload notification information to the cloud service offering’s secure portal or FedRAMP-compatible Trust Center.
If an incident affects the confidentiality or integrity of federal customer data, RFC-0031 also states CSPs must follow the Cybersecurity and Infrastructure Security Agency’s (“CISA”) Incident Notification Instructions to provide notice to CISA.
Incident Reporting Timeframes
The RFC proposes updating incident reporting timeframes to align with the sensitivity of the cloud service offering.
Importantly, as part of the FedRAMP 20x initiative, FedRAMP updated its naming conventions as follows (FedRAMP Authorization labels also have transitioned from FedRAMP “Authorization” to FedRAMP “Certification.”):

Proposed incident reporting timeframes are based on the Class Certification levels above and the estimated impact rating of the incident (specific timeframes depend on the assigned impact):
- Class A (Pilot) and B (Low): Reporting timeline ranges from 6 hours to one business day.
- Class C (Moderate): Reporting timeline ranges from 1 hour to one business day.
- Class D (High): Reporting timeline ranges from 15 minutes to one hour.
FedRAMP also contemplates ongoing reporting (as often as every 3 hours) as incidents are investigated.
Next Steps
RFC-0031 is open for comment from FedRAMP stakeholders until May 12, 2026 and comments can be posted via the FedRAMP RFC-0031 GitHub thread or emailed directly to pete@fedramp.gov.
FedRAMP plans to incorporate the outcome of the RFC (and others) into FedRAMP’s Consolidated Rule Set (“CR26”) set to be released in June 2026. This will be a major milestone compiling new FedRAMP rules in one place. Enforcement of CR26 is expected to begin December 31, 2026.Sheppard’s Governmental Cybersecurity and Data Protection team is continuing to track developments in the FedRAMP 20x and CR26 process and will continue to provide updates as they become available.
Pharmaceutical Committee Meeting: BIOSECURE Act Update, April 29
The Coalition’s Pharmaceutical Committee will host a meeting with Joy Sturm of Hogan Lovells for a briefing on the BIOSECURE Act. The meeting will be held virtually on April 29 at 12:00 PM (ET).
The BIOSECURE Act, signed into law on December 18, 2025, as part of the FY26 National Defense Authorization Act (NDAA), restricts U.S. federal agencies and recipients of federal funding from contracting with or using biotechnology equipment or services from designated “biotechnology companies of concern.” The legislation is intended to strengthen national security by limiting foreign access to sensitive biological data, particularly from companies with ties to China.

Issued on March 26, 2026, Executive Order 14398 directs federal agencies to incorporate a new contract clause addressing diversity, equity, and inclusion (DEI) activities, introducing significant new compliance considerations for contractors and subcontractors. The session provided an overview of the Executive Order, the forthcoming FAR deviation clause, and the anticipated timeline for implementation.
During the webinar, the speakers discussed the scope of the new clause, key compliance obligations, and the expanded penalties associated with noncompliance. They also shared a practical framework for how contractors can begin preparing for these changes, with insights relevant to Legal, HR, Contracts, and Subcontracts Management teams.

With TDR expanded across the Multiple Award Schedule (MAS) program through Refresh 31, contractors are now navigating important updates to reporting requirements and compliance expectations. The session provided a clear overview of key TDR requirements and practical considerations for contractors as implementation continues across the program.
During the webinar, Andrew and Lauren discussed the transition from Commercial Sales Practices (CSP) to TDR, key reporting elements including new requirements introduced through Refresh 31, how to report firm-fixed price orders, and best practices to support accurate and consistent reporting.

The Coalition hosted a webinar featuring PilieroMazza Partner Nichole Atallah to discuss legal updates impacting government contracts.
The session provided an overview of recent legal and regulatory developments shaping the federal marketplace, with a focus on how contractors can position their businesses in response to ongoing changes.
During the webinar, Nichole reviewed new SBA rule changes, cases impacting mentor-protégé and joint venture arrangements, and provided a refresher on the nonmanufacturer rule (NMR). She also discussed a recent GAO protest ruling involving a reseller and the Trade Agreements Act (TAA), Corporate Transparency Act (CTA) compliance considerations, updates on CMMC 2.0 implementation, and a national security memorandum addressing Artificial Intelligence (AI).

The Department of Veterans Affairs (VA) is excited to announce the upcoming MSPV Make PPE in America Industry Day on May 12, 2026. This event is intended to bring together suppliers, manufacturers, and industry stakeholders involved in the production and distribution of Personal Protective Equipment (PPE) to support the VA’s Medical/Surgical Prime Vendor Program. Our goal is to foster collaboration, share valuable insights, and enhance the procurement and supply chain processes for PPE necessary to serve our veterans and healthcare providers effectively.
This event will be held in conjunction with the Coalition for Government Procurement (CGP) Spring Training Conference, which will take place on May 13–14, 2026, at the same venue. Attendees interested in participating in the CGP Spring Training Conference can find more details and register below.
